Does Islam consider Shirk a greater sin than Zina (adultery/fornication)? - A thoughtful answer.
Article (68) In the name of Allah, the Most Gracious, the Most Merciful.
(An indispensable explanation in the context of faith and society)
Among the questions that are repeatedly raised to put Islam in the dock in the modern era, one important question is:
“If, according to the Quran, the greatest sin is Shirk (associating partners with God), then what is the place of Zina, especially heinous crimes like rape?”
The objectors present this question in such a way as if Islam gives preference to mere faith over human life, honor, and social corruption, whereas this objection is the result of a fundamental misunderstanding of the Quran and ignorance of the comprehensive system of thought of the religion.
This article is written to resolve this intellectual confusion, so that it can be clarified that:
Why is Shirk the greatest sin from a religious point of view?
Why is Zina, especially rape, the most serious crime from a social and human point of view?
And why has Islam kept both of them in separate but related spheres?
First: Shirk - the greatest sin from a religious point of view
The Holy Quran considers Shirk to be the greatest intellectual and faith-based destruction of human life, because Shirk:
Is a denial of Allah's Lordship, Divinity, and Sovereignty
Distorts the entire system of thought of man
Distorts the standard of good and evil
Allah Almighty says:
إِنَّ اللَّهَ لَا يَغْفِرُ أَن يُشْرَكَ بِهِ (An-Nisa: 48)
And it is said:
إِنَّ الشِّرْكَ لَظُلْمٌ عَظِيمٌ
(Luqman: 13)
This "great injustice" is because it is a robbery of the Creator's right, which eliminates the sense of accountability, the Hereafter, and moral obligation from the human heart. Although Shirk corrupts a person's faith, its scope is primarily related to belief.
Second: Zina - the most serious crime from a human and social point of view
Where the Quran declares Shirk to be the greatest crime of faith, it also describes Zina as the root of social destruction:
وَلَا تَقْرَبُوا الزِّنَىٰ ۖ إِنَّهُ كَانَ فَاحِشَةً وَسَاءَ سَبِيلًا (Al-Isra: 32)
Islam has given man honor and dignity: وَلَقَدْ كَرَّمْنَا بَنِي آدَمَ (Bani Israel: 70)
To protect this dignity, marriage was made lawful and Zina was forbidden, and a punishment was prescribed for it:
اَلزَّانِيَةُ وَالزَّانِي فَاجْلِدُوا كُلَّ وَاحِدٍ مِّنْهُمَا مِائَةَ جَلْدَةٍ (An-Nur: 2)
Zina is not just a moral lapse, but:
An attack on the family system. Violation of the honor and chastity of women
Destruction of lineage. And the murder of social trust. That is why Islam has declared it a major sin and prescribed severe punishment. Explanation of the objection to the word "woman".
In Islam, calling a woman "woman" or "Nisa" does not mean imprisoning her or depriving her of her authority, but it is: a symbol of her honor, sanctity, and precious position. Islam considers woman not as an object but as a trust, that is why it has made the protection of her chastity the responsibility of the entire society.
Third: Two basic types of Zina
(1) Zina bil Raza (Consensual Adultery/Fornication)
This is the sin in which the consent of both parties is involved, but consent does not justify the sin.
Islam has given the following to prevent it:
Modesty
Moral training
Encouragement of marriage
And a system of social monitoring
The Quran says:
وَمِنْ آيَاتِهِ أَنْ خَلَقَ لَكُم مِّنْ أَنفُسِكُمْ أَزْوَاجًا لِّتَسْكُنُوا إِلَيْهَا
(Ar-Rum: 21)
And reminds of collective responsibility:
كُنتُمْ خَيْرَ أُمَّةٍ… تَأْمُرُونَ بِالْمَعْرُوفِ وَتَنْهَوْنَ عَنِ الْمُنكَرِ (Al-Imran: 110)
The Prophet (peace and blessings of Allah be upon him) said:
"Whoever among you sees an evil, let him stop it with his hand, and if he cannot, then with his tongue, and if he cannot do that either, then let him hate it in his heart. And this is the weakest level of faith."
(Sahih Muslim: 49)
(2) Zina bil Jabr (Rape)
This is not just Zina but: oppression, corruption on earth, and the worst violation of the rights of people.
In this, the woman's will is taken away, and both her soul and body are injured; that is why from a jurisprudential point of view, it is a serious criminal offense.
A basic jurisprudential principle
Huquq Allah (Rights of Allah): Those rights that a servant has upon his Creator; their forgiveness depends on the will of Allah.
Huquq al-Ibad (Rights of People): Those rights that people have on each other; their forgiveness is not possible without the consent of the affected person.
The basic point is that:
Every sin that injures a person's life, honor, or authority, does not remain only Huquq Allah but also becomes Huquq al-Ibad, and in this, the requirement of worldly justice becomes necessary.
It should also be clear that:
Zina, in its origin, is absolutely among the Huquq Allah (whether it is bil Raza or bil Jabr)
But in Zina bil Jabr, an additional aspect arises due to the word Jabr (force), which makes it oppression.
On this basis, the punishment and penalty will be enforced only on the oppressor, not on the oppressed.
Fourth: What if someone accepts Islam after rape?
To say that the criminal escapes punishment by accepting Islam is legally and rationally wrong.
By accepting Islam:
The sins of disbelief are erased
But Huquq al-Ibad are not waived
The enforcement of Sharia law fulfills the worldly punishment, but the actual forgiveness of sin depends on repentance, remorse, and the mercy of Allah.
الحدود تُدرأ بالشبهات، لا بالدعویٰ
(Hudud are averted by doubts, not by claims)
The Quran says:
إِنَّ اللَّهَ يَغْفِرُ الذُّنُوبَ جَمِيعًا
(Az-Zumar: 53) - Akhravi Maghfirat (Hereafter Forgiveness)
وَلَكُمْ فِي الْقِصَاصِ حَيَاةٌ
(Al-Baqarah: 179) - Dunyawi Adl (Worldly Justice)
The purpose of Hudud is not revenge but: the reformation of the individual, the redressal of the oppressed, and the protection of the society.
Fifth: Moral Preference - If Zina bil Jabr and Shirk are together.
If there is a situation where Zina bil Jabr and Shirk are closely present, then the Islamic and moral preference is to stop Zina bil Jabr first, because here life, honor, and Huquq al-Ibad are in immediate danger.
The Quran says:
وَمَا لَكُمْ لَا تُقَاتِلُونَ… وَالْمُسْتَضْعَفِينَ
(An-Nisa: 75)
The Prophet (peace and blessings of Allah be upon him) said:
"Help your brother, whether he is an oppressor or an oppressed."
It was asked: How to help the oppressor?
He said: "Stop him from oppression, that is his help." (Sahih Al-Bukhari: 2444)
Shirk is the greatest sin of faith, but since it is related to the rights of Allah, its correction will be done later; the immediate protection of humanity takes precedence.
In short, Islam does not classify sins on the same scale: Shirk is the greatest sin from a religious point of view
Zina, especially Zina bil Jabr, is the greatest crime from a human and social point of view
These two spheres are separate, but justice and accountability are necessary in both.
Islam: Protects faith as well
And also the honor of man. Shirk hollows out the faith,
And Zina wounds the soul of the society.
That is why Islam declares war against both -
With justice, with wisdom, and with full human consciousness.
اَللّٰهُمَّ أَرِنَا الْحَقَّ حَقًّا وَارْزُقْنَا اتِّبَاعَهُ،
وَأَرِنَا الْبَاطِلَ بَاطِلًا وَارْزُقْنَا اجْتِنَابَهُ۔
O Allah! Protect our faith,
And protect our society from oppression, immorality, and intellectual deviation. Amen.
